Acceptance
By creating an account or using Sonic Bloom, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.
Accounts
- You must be 18 or older (or have the consent of a parent or guardian) to create an account.
- You agree to provide accurate information and keep it current.
- You are responsible for maintaining the security of your account and for all activity that occurs under it.
- Notify us immediately if you suspect unauthorized access.
Subscription and Payment
- Paid plans are billed monthly or annually, as selected at signup. Prices are shown on the pricing page.
- Payment is processed by Stripe. By subscribing you authorize recurring charges to your payment method.
- You may cancel at any time from the billing dashboard. Access continues to the end of the paid period.
- Refunds are not issued for partial periods except where required by applicable law.
Payments, Sales, and Taxes
Sonic Bloom is a platform and technology provider. We give artists the tools to sell directly to their fans — we do not buy, sell, or resell any artist's goods, music, or content.
When a fan buys from an artist on Sonic Bloom — including digital releases, merchandise, tips, and Fan Club memberships — the sale is a transaction between the fan and the artist. The artist is the seller and the merchant of record for that sale. This means:
- The artist is solely responsible for their own goods and content, including fulfillment, delivery, and customer service.
- The artist is solely responsible for all taxes arising from those sales — including sales tax, VAT, and GST — and for any registration, collection, or filing those taxes require.
- Payments are processed by Stripe and settle directly to the artist's connected Stripe account.
- Sonic Bloom takes 0% commission on artist sales and does not calculate, collect, or remit tax on the artist's behalf.
Sonic Bloom is the merchant of record only for its own subscription fees, described above. For all other purchases, the artist — not Sonic Bloom — is the seller.
Refunds and Disputes
Because the artist is the seller and merchant of record, any refunds, returns, cancellations, or chargebacks for fan purchases — digital releases, merchandise, tips, or Fan Club memberships — are the artist's responsibility, and the artist sets any applicable refund or return policy. Sonic Bloom provides tools for artists to issue refunds but is not a party to these transactions and does not issue refunds on an artist's behalf. Refunds of Sonic Bloom's own subscription fees are governed by the Subscription and Payment section above.
Content Ownership
You own the content you upload. By uploading content to Sonic Bloom you grant us a limited, non-exclusive license to host, display, and deliver that content as part of operating the platform — including sending the messages you initiate. We do not claim any ownership rights over your music, photos, bios, or any other material you create.
Acceptable Use
You agree not to use Sonic Bloom to:
- Upload or distribute illegal content or content that infringes on third-party rights.
- Harass, threaten, or defame any person.
- Send spam or unsolicited bulk messages.
- Send SMS to phone numbers that have not provided explicit consent.
- Circumvent any access controls, rate limits, or security features of the platform.
SMS Program Acceptance
If you use the SMS feature, you confirm that:
- Every phone number on your list opted in with explicit, documented consent to receive SMS from you.
- You are responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and any applicable local SMS laws.
- You agree to honor STOP and HELP keyword replies from your subscribers.
- Carriers are not liable for delayed or undelivered messages.
- Fans can opt out at any time by replying STOP to any message.
Termination
Either party may terminate at any time. We may suspend or terminate accounts that violate these Terms, with or without notice, at our discretion. Upon termination, your access to the platform ends and we may delete your content in accordance with our data retention policy.
Disclaimers
Sonic Bloom is provided "as is" without warranties of any kind, express or implied. We do not warrant uninterrupted, error-free, or completely secure service.
Limitation of Liability
To the maximum extent permitted by law, Sonic Bloom's total liability to you for any claim arising out of or related to these Terms or the platform shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
Governing Law
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles.
Changes to These Terms
We may update these Terms from time to time. We will notify artists of material changes via email. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
